Accommodation Provider Terms and Conditions
The University of Southern Queensland (‘UniSQ’) hosts the platform ‘StudyStays’ (‘UniSQ Accommodation Listings’) to assist current and prospective UniSQ students (‘Students’) in finding off-campus accommodation. By using UniSQ Accommodation Listings, property owners, real estate agents, accommodation providers and others (‘you’) you agree to be bound by the following terms and conditions:
Scope of services
Advertising process
- You may submit an accommodation advertisement application on UniSQ Accommodation Listings, free of charge. To submit an application, you must complete an online application on the UniSQ Accommodation Listings self-service portal, available here. You must provide accurate and current information when submitting an accommodation advertisement application. There is also no ongoing fee should your accommodation advertisement be listed on UniSQ Accommodation Listings.
- There is no limit to the number of accommodation advertisement applications that you can submit for listing on UniSQ Accommodation Listings.
- You warrant that each of your accommodation listing applications complies and will continue to comply if the application is successful, with all applicable laws including the Residential Tenancies and Rooming Accommodation Act 2008 (Qld).
- Upon receipt of your application, UniSQ will review the application within a reasonable timeframe and notify you of the outcome of your application. As part of the review of your application, you may be contacted to validate some or all aspects of the application.
- UniSQ may, in its absolute and sole discretion, refuse to publish an accommodation advertisement.
- Nothing in UniSQ’s assessment of an accommodation advertisement should be taken as UniSQ determining, agreeing or otherwise acknowledging that a particular accommodation advertisement or, the property itself, complies or does not comply with any legal requirements.
- If an accommodation advertisement is published, the advertisement will remain live on UniSQ Accommodation Listings until the earlier of:
- you removing the accommodation advertisement;
- the automated expiry of the advertisement, being 1 month from its listing; or
- UniSQ removing the accommodation advertisement at any time, and in its sole discretion without prior notice to you. UniSQ is under no obligation to disclose its reasons for removing an accommodation advertisement, to you. UniSQ is not liable for any inconvenience or loss (whether monetary or other) caused by removal of an accommodation listing.
- UniSQ does not match Students with an accommodation listing and does not guarantee that you will find a tenant as a result of your registration with UniSQ Accommodation Listings.
- The inclusion of any accommodation listing on UniSQ Accommodation Listings does not constitute an endorsement or recommendation by UniSQ of that accommodation listing.
Student or third-party Responsibility:
- UniSQ is not responsible nor liable for the actions or omissions of any Student or third party in any circumstances whatsoever including but not limited to:
- damage to your property (including the property subject to the accommodation listing); or
- payment or nonpayment of any amount to you, including rent, water, electricity or internet costs.
- UniSQ does not make any warranties, guarantees or representations about the suitability of prospective tenants or their communications with you. You are advised to exercise your own judgment and conduct thorough research before making any accommodation arrangements with a Student.
- Any issues or disputes arising from any accommodation arrangements must be resolved directly between the Student and you. Further assistance may be available by contacting the Residential Tenancies Authority on 1300 366 311.
Liability Limitation and Insurance
- Your use of UniSQ Accommodations Listings is at your own risk. To the maximum extent permitted by law, UniSQ disclaims all liability whatsoever to you for any loss, damage or inconvenience you may incur as a result of, or in connection with, your use of UniSQ Accommodation Listings.
- You agree to indemnify UniSQ (including its agents and employees) from and against any and all claims, liabilities, damages, losses, costs and expenses (including legal fees on an indemnity basis) arising out of or in connection with:
- any breach of these terms and conditions by you, your agents, employees or representatives;
- any negligence or wilful misconduct by you, your agents, employees or representatives; and
- any violation of applicable laws or regulations by you, your agents, employees or representatives;
- This indemnity obligation shall survive 7 years after the date the accommodation listing is removed or otherwise de-listed from UniSQ Accommodation Listings.
- UniSQ does not provide insurance coverage for you (including for property or legal liability). You are responsibly for obtaining your own insurance to cover any potential loss or damage to the accommodation or for your legal liability.
Maintenance and Repairs
- UniSQ is not responsible for the maintenance or repair of any accommodation provided by you.
Privacy and Data protection
- You understand that UniSQ will have access to any personal information that has been collected about you as part of your registration with UniSQ Accommodation Listings. UniSQ deals with personal data in accordance with its Privacy Policy which can be found here.
Termination
- UniSQ reserves the right to suspend or terminate your UniSQ Accommodation Listings registration if you fail to comply with these terms and conditions, or your ongoing use of UniSQ Accommodation Listings is likely to bring the reputation of UniSQ into disrepute or cause UniSQ to be in breach of any applicable law.
Amendment
- UniSQ reserves the right to amend or replace these terms and conditions at any time and for any reason, and without prior notice to you.
